Terms of Service

These Terms of Service ("Terms") govern your use of Upwind at joinupwind.app. By creating an account, or by continuing to use an existing account after being asked to accept these Terms, you agree to them. If you don't agree, don't use Upwind.

Upwind ("Upwind," "we," "us," or "our") doesn't yet operate as a formally incorporated company; until it does, these Terms are between you and Upwind's founder, operating as Upwind. Our Privacy Policy, incorporated into these Terms by reference, explains what we collect and how we use it.

What Upwind is

Upwind is a workspace that helps you organize your own college recruiting: a catalog of opportunities we source only from official channels — employer career pages and application-tracking systems, never by scraping job boards or aggregating other sites — plus your own pipeline, documents, contacts, and reminders layered on top.

Upwind is a tool, not a guarantee. Using Upwind doesn't guarantee you'll get an interview, an offer, or any particular outcome.

Who can use Upwind

Upwind is intended for current and prospective college students. We don't currently verify student status, but using Upwind for a purpose it isn't intended for — for example, scraping or reselling the catalog — violates these Terms and is grounds for us to suspend or terminate your account.

By using Upwind, you represent that you're at least 13 years old, and that if you're under 18, you have the legal capacity to agree to these Terms or a parent or guardian's permission to do so.

Your account

You sign in with Google. You're responsible for keeping your Google account secure — anyone who can sign into your Google account can sign into Upwind. Each Upwind account is for one person; don't share your account.

Acceptable use

  • Don't scrape, crawl, or programmatically extract data from Upwind.
  • Don't misrepresent information in a custom opportunity entry — the catalog and your own entries should reflect real roles.
  • Don't attempt to circumvent, disable, or abuse the reminder system, rate limits, or any other part of Upwind's infrastructure.
  • Don't attempt to access another user's account or data, or to re-identify an individual from the aggregate club or institutional statistics described in our Privacy Policy.
  • Don't use Upwind to impersonate anyone, or upload content you don't have the right to upload.

Your content

You own what you enter into Upwind — your profile, files, pipeline, notes, and everything else you create or upload. You're responsible for it: for its accuracy, for making sure you have the right to upload it (for example, a resume or transcript is yours to upload), and for anything that comes of entering it.

You grant us a limited license to store, process, and display your content back to you in order to run Upwind, and to include it in the aggregate, group-level analytics described in our Privacy Policy. We don't otherwise use, share, or sell your individual content.

If you believe something on Upwind infringes your rights — for example, a club logo — email mahmoud@joinupwind.app and we'll look into it and remove infringing content.

Club and partner access

If you're an officer of a club partnered with Upwind, or belong to a partner institution's team, your account may have access to a dashboard of aggregate statistics about your club's or institution's members, as described in our Privacy Policy. That access comes with obligations: use it only for your own club's or institution's reporting, don't attempt to re-identify an individual member from a small-cell or ranged statistic, and don't share your access credentials with anyone else.

Opportunity listings aren't guaranteed

Upwind's catalog links to opportunities on third-party sites we don't control. We try to keep listings accurate and current, but we can't guarantee that a listing is accurate, that a link still works, or that a deadline hasn't changed — always confirm details on the employer's own site before you rely on them, especially deadlines. We track this closely, and our own quality checks regularly find stale links between updates — which is exactly why this section exists rather than being boilerplate.

Fees

Upwind is free to use today. If that changes for some or all of the product, we'll tell you before any fee applies to you.

Suspension and termination

You can stop using Upwind at any time. We may suspend or terminate an account that violates these Terms.

If you don't accept an updated version of these Terms or our Privacy Policy, your account is paused rather than deleted: you're signed out, your data stays as it is, and you can come back and accept whenever you choose. A terminated account is handled the same way — data is retained, not deleted, unless you ask us to delete it (see our Privacy Policy) or the law requires otherwise.

No warranty; limitation of liability

Upwind is provided "as is," without warranties of any kind, express or implied. We don't warrant that Upwind will be uninterrupted, error-free, or that any information in it — including third-party listings — is accurate or complete.

To the fullest extent the law allows, Upwind and its founder aren't liable for indirect, incidental, or consequential damages arising from your use of Upwind, including a missed deadline, an inaccurate listing, or lost data. Nothing in these Terms limits liability where the law doesn't allow it to be limited.

Disputes and governing law

These Terms are governed by the laws of New Jersey, without regard to conflict-of-law rules, and any dispute will be handled in the courts located there.

Changes to these Terms

We may update these Terms as Upwind changes. If we make a material change, we'll ask you to accept the updated version — the same acceptance flow that applies today. Every version is dated, and we keep a record of which version you accepted and when.
